1. Introduction and acceptance

Welcome to the Domestic Appliance Guard website at www.domesticapplianceguard.com (the "Website"). These Website Terms of Use (the "Terms") govern your access to and use of the Website, including any content, tools, quote journeys and customer portal features made available through it.

By accessing or using the Website you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website.

These Terms apply to your use of the Website only. If you purchase a cover plan from us, that plan is governed by the applicable plan terms and conditions, which are available on our Terms & Conditions page and are provided to you at sign-up. We may suspend or withdraw your access to the Website, or any part of it, if we reasonably believe you have breached these Terms.

4. Accounts and customer portal

Some areas of the Website may require you to register or log in, for example to manage your plan, book a service or report a fault. You are responsible for keeping your login details confidential and for all activity that takes place under your account. You must notify us promptly if you believe your account has been accessed without your authorisation.

We are the owner or licensee of all intellectual property rights in the Website and its content, including the Domestic Appliance Guard name and logo, text, graphics, images, page designs, software and the arrangement of the Website. These works are protected by copyright, trade mark and other intellectual property laws in the United Kingdom and around the world. All such rights are reserved.

You may print or download extracts of Website content for your personal use, provided you do not modify the content and do not remove any copyright or proprietary notices. You must not use any part of the Website content for commercial purposes without first obtaining a licence from us.

Nothing on the Website grants you any right to use any trade mark, logo or brand name displayed on it, whether ours or belonging to a third party, without the owner's permission.

6. Website content and accuracy

We take reasonable care to ensure the content on the Website is accurate and up to date, but the Website is provided for general information only. Content on the Website does not constitute advice, and you should not rely on it as the basis for any decision without checking the position with us directly.

Plan features, prices, fees and availability described on the Website are subject to the plan terms and conditions provided at sign-up, and may change from time to time. The plan documentation you receive when you take out a plan sets out the definitive terms of your cover.

We may update, amend or remove content on the Website at any time without notice.

7. Availability of the Website

We do not guarantee that the Website, or any content on it, will always be available, uninterrupted or free from errors. We may suspend, withdraw or restrict the availability of all or any part of the Website for business or operational reasons, including maintenance and upgrades.

You are responsible for making all arrangements necessary to access the Website and for ensuring that anyone accessing it through your internet connection is aware of these Terms.

8. Links to other websites

The Website may contain links to third party websites and resources. These links are provided for your convenience only. We have no control over the content of third party websites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply our endorsement of the linked website.

If you wish to link to the Website, you may do so provided you do it in a way that is fair and legal, does not damage or take advantage of our reputation, and does not suggest any association, approval or endorsement by us where none exists. We reserve the right to withdraw linking permission without notice.

9. Our liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.

Subject to the paragraph above, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising from or in connection with your use of, or inability to use, the Website, or your reliance on any content displayed on it, where that loss or damage was not reasonably foreseeable.

We are not liable for business losses. The Website is intended for domestic and private use. If you use the Website for any commercial or business purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Nothing in these Terms affects your statutory rights as a consumer. Your rights in relation to any cover plan you purchase from us are set out in your plan terms and conditions and are unaffected by this section.

10. Viruses and security

We do not guarantee that the Website will be secure or free from bugs or viruses. You should use your own virus protection software. You must not misuse the Website by knowingly introducing viruses, trojans, worms or other malicious or technologically harmful material, and you must not attempt to gain unauthorised access to the Website or any server, computer or database connected to it. Any such breach may be a criminal offence under the Computer Misuse Act 1990 and we will report any such breach to the relevant authorities.

11. Privacy and cookies

Any personal data you provide through the Website is handled in accordance with our Privacy Policy, and our use of cookies is explained in our Cookie Policy. Both are available on the Website and form part of the framework governing your use of it.

12. Changes to these Terms

Your continued use of the Website after changes are published constitutes acceptance of the amended Terms.

13. General

If any provision of these Terms is found by a court to be invalid or unenforceable, that provision will be treated as deleted to the minimum extent necessary and the remaining provisions will continue in full force and effect.

If we do not enforce any right or provision under these Terms, that does not constitute a waiver of that right or provision.

These Terms are between you and us. No other person has any rights to enforce any of these Terms.

14. Governing law and jurisdiction

These Terms, their subject matter and their formation are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising from or related to your use of the Website, except that if you are a resident of Scotland you may also bring proceedings in Scotland, and if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland.
